FAQs

What is professional negligence?

Professional negligence is when someone is paid for professional expertise and fails to meet the expected standard of care. Claims require four elements:

  • A duty of care existed
  • There was a breach of that duty
  • The breach caused a loss
  • The loss can be quantified

Loss covers both direct financial loss and loss of chance, for example, where the negligence resulted in the claimant losing the opportunity to negotiate a fair price.

Example of professional negligence

Professional negligence can apply to a wide range of professionals providing specialist services, as long as they have fallen below the standard of care reasonably expected of them, resulting in a loss. For example:

A surveyor fails to identify subsidence and instead describes it as settlement. The buyer later discovers structural movement requiring £50,000 of underpinning work. If the property was valued at £200,000 but should have been valued at £160,000, the buyer may claim the difference or claim loss of opportunity to renegotiate or withdraw from the purchase.

Is there a limitation period for professional negligence claims?

Yes, there is a limitation period for professional negligence claims, although it can vary depending on the specifics of your case. Typically, claims must be brought within six years from the date of the breach or three years from the date you became aware of the issue. As limitation periods apply, you should seek expert legal advice as soon as possible.

What are the consequences of professional negligence?

Having a professional negligence claim made against you can have serious implications, from being unable to practise your profession or obtain vital insurance to having to cover the claimant’s losses. In some cases, insurers may not cover the full extent of the claim, leaving you personally exposed. If you are facing a claim, you should seek expert advice from a specialist professional negligence solicitor as soon as possible.
