Do you have to try Alternative Dispute Resolution (ADR) before going to court?
Courts in England and Wales are increasingly encouraging the use of Alternative Dispute Resolution (ADR), and for good reason. Resolving disputes through non-court-based dispute resolution processes tends to be quicker and less expensive for all parties involved and helps to relieve pressure on the court system. Despite these benefits, alternative dispute resolution is still not mandatory for all cases. However, proposed changes to the law and new precedents could see more people being required to consider non-court-based dispute resolution processes. Churchill v Merthyr Tydfil County Borough Council [2023] EWCA Civ 1416 In the case of Churchill v Merthyr Tydfil, a relatively simple dispute over Japanese Knotweed resulted in a landmark decision for the legal system. Churchill had started legal proceedings against Merthyr Tydfil County Borough Council, claiming they had allowed the destructive plant species to spread from their land onto … Continue reading

Do I need planning permission for my extension?
Are you thinking about extending your home? Before diving into construction and getting the sledgehammer out, it’s crucial to consider a few key points and to check if you need planning permission for your extension. You should start by checking your local council planning portal and reading the guidelines. If after reading you are still uncertain, you do have the option to submit a pre-planning application via the local authority website to seek guidance from a local authority planning advisor. Do I need planning permission? Certain types of minor changes can be made without the need for planning permission, under permitted development rights. A pre-planning application will confirm whether the work requires planning permission, or whether it falls under permitted development. Alternatively, an architect can assist if navigating the guidelines is daunting, or you’d prefer to seek expert advice. Do … Continue reading

Scott Bailey skydives for Maggie’s Charity
On the 19th April, Victoria and Merrin from the Scott Bailey conveyancing department, will be taking the plunge by skydiving to raise funds for Maggie’s charity. This courageous leap is dedicated to our dear colleague Elayne, who is bravely facing the challenges of breast cancer. After six years of being in the clear, Elayne received the unexpected news of her cancer’s return, now as secondary breast cancer. Initially mistaken for a mere backache, this has been a huge shock for Elayne and her family. Despite the cancer being incurable, Elayne embarks on her palliative treatment with unwavering optimism, demonstrating nothing but a positive spirit in the midst of formidable challenges, and we are immensely proud of her. “We were recommended to Maggie’s Centre at Southampton General Hospital by my Oncologist. They are offering much-needed support and practical help to both … Continue reading

Scott Bailey LLP’s New Forest Women in Business
